Subject: USCF, Goichberg, Berry, Bauer, Hough and Hall have a new attorney
|
In a surprising development, a new attorney has been assigned to defend the USCF, and Goichberg, Berry, Bauer, Hough and Hall in the case pending in the United States District Court in Lubbock, Texas entitled Susan Polgar vs. USCF et al. However, the other defendants, Lafferty, Mottershead, Bogner, Chess Magnet Schools, Continental Chess Association, Hanken and Kronenberger continue to be represented by the same attorney that they have had from the beginning, who is William Huttenbach. I have no idea why this has happened. Perhaps it comes from a complaint on Polgar's side of a conflict of interest between the USCF Board and non-board members who do work for the USCF, such as Hanken and Bogner. Another possible theory is that the insurance company, Chubb Corp., has reportedly notified the board that they will be dropping the USCF as a client for Directors and Officers insurance and this change of attorneys is related to that. The new counsel for the USCF, and Goichberg, Berry, Bauer, Hough and Hall is Jeffrey B. Jones Jones, Flygare, Brown & Wharton, PC PO Box 2426 Lubbock, Texas 79408 I have no idea what the reason is for this change in attorneys. It is interesting that the Continental Chess Association and Bill Goichberg now have different attorneys. At almost exactly the same time, there has been a change of attorneys for Gregory Alexander in the New York case, but in that case the reason for the change is obvious. It is disturbing that the entirely frivolous Susan Polgar case filed in Texas has run up such huge legal fees. Sam Sloan

The current Board members are each named "... individually and in his Representative capacity as Member of the Executive Board." You are listed only as an individual. Tell us, Sam, what tortious acts did you commit whjile polluting the Board? 2) _Your_ lawsuit is a dead issue. Dismissed with prejudice, remember? =93(T)he complaint largely interweaves purported 'facts' with Sloan=92s own subjective rantings and commentary and commentary about their alleged shortcomings. For the most part, these are simply personal, vindictive, and nonsensical attacks that do not belong in a pleading filed in a judicial proceeding.=93 I guess you follow the old maxim about publicity: don't read it, measure it. Doltishness, thy name is Sloan.
Mr. Jones was appointed counsel in Texas for me, the EB members and the USCF by the General Liability carriers, when they came back with the ruling on our submission that they had a duty to defend. Mr. Huttenbach is still retained as USCF counsel as well. This will save the USCF significant fees going forward. I am unaware of any offer to Mr. Sloan for him to be represented by USCF counsel, and I highly doubt such an offer was made due to the fact that we were (and still are) defending a suit in NY filed by Mr. Sloan against the USCF, et al.
Mr. Hall is mistaken and I am very surprised to see him write this. Obviously, I have the right to be represented by USCF's counsel because I am covered by the USCF's Directors and Officers Insurance Policy. Mr. Hall should be thanking me for not costing the USCF any additional expense by representing myself, instead of writing the hostile posting above. Please note that Susan Polgar and Paul Truong plus Gregory Alexander are still being represented by counsel provided through the USCF's Directors and Officers insurance policy, even though they are both suing and being sued by the USCF. Also, Mr. Hall should look within himself and consider the things that he did and continues to do to provoke my lawsuit. Sam Sloan

More than that I'm not going to say to you.
