Subject: Possible Fraud in Truong Bankruptcy Filing
There is a question as to whether Susan Polgar and Paul Truong may
have committed bankruptcy fraud.

On May 13, 2007, the Lubbock Texas newspapers announced that Susan
Polgar and Paul Truong had been hired to run the chess program there.

http://www.lubbockonline.com/stories/051307/loc_051307065.shtml

However, on June 21, 2007, more than one month later, Paul Truong
filed a bankruptcy petition stating that he was unemployed and his
only assets were his clothing, furniture and $40 in cash.

However, that might not be fraudulent or illegal, assuming that Truong
had not yet reported to work at Texas Tech or received his first pay
check. It might be unethical but it is done all the time.

A more serious problem comes with the Polgar books, videos and DVDs
most of which were produced by Paul Truong. Amazon lists numerous
chess books and videos jointly by Susan Polgar and Paul Truong. For
example:

http://www.amazon.com/dp/081293671X/

The real problem concerns a Truong alias, Paul Derazza. Derazza is the
maiden name of Paul's first wife and the mother of his children. Tim
Tobiason told me at the US Championship in Stillwater Oklahoma on May
17, 2007 that Paul Derazza was an investor who had purchased the
rights to all the Susan Polgar books, videos and DVDs. Mr. Tobiason
said that he was certain that Paul DeRazza was not the same person as
Paul Truong and that he had spoken to Paul DeRazza on the telephone.

However, Paul Truong has since said that there is no such person as
Paul DeRazza.

What may have happened is that Paul Truong and Susan Polgar sold the
rights to all their chess books, videos and DVDs to Paul DeRazza, who
is a fake, non-existent person.

Paul Truong then files for bankruptcy, thereby wiping out $52,000 in
mostly credit card and bank debts. His major creditor was American
Express.

Paul Truong then starts working at Texas Tech University free of debt
and still holding the rights to the Polgar books, videos and DVDs.

If this is what happened it would not be surprising. This sort of
bankruptcy fraud is extremely common, and rarely prosecuted.

However, in this case, Paul Truong was also running for election. The
votes were counted on July 26, 2007 and Truong and Polgar were
elected. They took office on August 5, 2007. They are now on the board
of directors of an organization with 86,000 members.

This may be their undoing when and if those 86,000 members suspect
Polgar and Truong of bankruptcy fraud.

Here is the Truong Petition in Bankruptcy filed on June 21, 2007 and
the order of the Bankruptcy Court dated October 30, 2007 discharging
Paul Truong in bankruptcy.

http://www.anusha.com/truong-bankruptcy-petition.pdf

http://www.anusha.com/truong-discharge.pdf

Note that on August 5, 2007 Paul Truong was elected to the position of
Vice President of Marketing and Communications of the United States
Chess Federation. Nobody in the USCF knew that Mr. Truong had a
bankruptcy petition filed and pending at that time.

Sam Sloan filed a lawsuit in federal court on October 2, 2007 entitled
Sloan vs. Truong. Although Paul Truong was discharged in bankruptcy on
October 30, 2007 that does not affect the Sloan lawsuit because Sloan
was not listed as a creditor in the bankruptcy petition. It does mean
that Truong cannot file another bankruptcy petition for six years and
thus any judgment obtained against Mr. Truong cannot be discharged in
bankruptcy before that time.

Jerry,
The rights to the DVD's aren't owned by Paul Truong or Paul
DeRazza( whoever that is!) I know but I am not going to say. I am just
waiting of Lafferty, et al to dig themselves into a hole there is no
way out of. LOL

I have no reason to conclude that anyone other than Pufferfish and
Chesspiece receive the royalties from their DVDs and books, just as they
earn income form Susie's paid appearances around the US and the world.
Tobiason is an interesting guy, but is a bit lacking in credibility. I
would want whatever he represents to be fact to be verified by at least
two other independent sources.

Frankly, it would make more sense that such a scheme would be used to
commit tax fraud as opposed to bankruptcy fraud. It's a common enough
scheme.

What evidence is there which ties Paul Truong to Paul DeRazza, other
than the name? Is this actually a known alias, or is this just
speculation? In any case, it would seem to be important to determine
whether there is a clear link between the two. If there is, and the
sale of books happened as you said, it looks like an entirely
different level of impropriety than the other issues. The other
accusations are all that Truong misrepresented himself; this would be
a direct fraud for financial gain. If there is no link between Truong
and DeRazza, of course, then this charge is not on the table, and
Truong might well be able to argue that all the other actions even if
true are not criminal.

Polgar was doing community outreach for SPICE in Texas in May, 2007.
TTU announced in May, 2007 that they had both been hired by TTU.
Can one sign an executory employment contract and purposely delay the
start date so that one can file for bankruptcy? I doubt it, but I'll
check on the issue. I think the other aspect that is damning is the trip
they led to Hungary and the other aspects of her for profit business
schedule that Truong represented as being solidly booked through early
2009--that representation having been made by Truong in February, 2007.
Of course, the other big question is whether or not they declared all
income on the Federal and State tax returns. I suspect that will be
looked into by the IRS, particularly if the bankruptcy judge had a copy
of his latest income tax filing and it does not make sense in light of
his business income with Susie.

An Intelius public record search came up with a known alias for Paul
Truong, that being Paul Derazza. Truong confirmed in an email to the
FOC that Derazza is his ex-wife's maiden name. Another person also ran a
similar search with a different public records search firm and came up
with the same alias and the same addresses for both Paul Truong and Paul
Derazza.

Recently, I came across a business people search web site that carries
listings for Paul Truong, Hoainhan M. Truong, Hoainhan Truong and
Kathleen and Hoainhan Derazza. As far as I can determine, Truong has
never used the alias Clark Rockefeller. :-)
