NOTIFICATION OF DISCIPLINARY ACTION
Date: January 5, 2006
To: Sam Sloan
Your post to the USCF Forums on January 2nd in the USCF Issues Forum
was in violation of the Acceptable Usage Guidelines for the USCF Forum
because it referenced a confidential matter that you had knowledge of
only as a member of the Executive Board.
This is a 2nd level sanction, because of your earlier violation of the
AUG back in June when you posted a solicitation for funds.
Accordingly, and after consultation with the USCF Executive Director,
you have been suspended from posting to the USCF Forums for a period of
one week. This suspension is effective immediately and will be in
effect until one week after the point at which you acknowledge this
notification.
You may appeal this sanction via email or equivalent written form to
the USCF Executive Director, who can lift the sanctions imposed, reduce
them, or increase them.

Disciplinary Procedures

Disciplinary Procedures for the USCF Forums, as approved by USCF
Executive Director Bill Hall:
1. All First Level or higher Sanctions called for under these
procedures will last for the designated time period from the point at
which the suspenion notice has been acknowledged by the individual. For
example, a one week suspension notice issued on Monday and acknowledged
on Wednesday will last until the following Wednesday. Depending upon
how sanctions are implemented, a sanction may remain in effect until
11:59:59 PM of the day it is due to expire.
2. Time Out Sanction: Because the Forums deal with topics on which
people have widely varying opinions, discussions can sometimes get out
of hand. The Moderators may publicly request individuals participating
in a 'flame fest' or rapid fire posting feud to take a voluntary 24
hour time out, during which time they are asked not to post to any
topics in the Forums.
If this voluntary time out does not quell the flame fest, the
Moderators may publicly impose a mandatory 24 or 48 hour time-out on
these individuals. A voluntary or mandatory Time Out Sanction does not
elevate the poster's current sanction level but may, at the Moderator's
discretion, be treated as if it were a First Level sanction for the
purpose of assessing future sanctions.
3. First Level Sanction: The first time someone posts something that is
a significant violation of the Forum 'acceptable usage guidelines', the
individual is warned and asked to delete or edit that post to bring it
into compliance. These warnings will be in public, through the Forums,
and via email. The individual is suspended from posting for a period of
24 hours. (See Paragraph 1.)
4. An offending post that is not corrected by the poster may be removed
or edited by the Moderators as needed to bring it into compliance with
the 'acceptable usage guidelines'.
A copy of the offending post will be made before it is removed or
edited, to preserve the record of the offense.
5. Exception to the above: Blatantly commercial posts, eg,
advertisements for things other than chess events, solicitations of
funds, 'spam', etc. will not be edited but will always be deleted
(Solicitations of funds for worthy charitable causes may be permitted
by the Executive Director.)
If this is the first time the spamming poster has posted to the Forums,
the poster will be permanently banned from the Forums as a spammer and
other steps may be taken by the Moderators to keep the spammer from
returning under another name.
Otherwise, the poster will treated as if this was a Second Level
Sanction.
6. Posts that are intentionally made to the wrong forum may be moved to
a more appropriate forum by the Moderators, and posts made to multiple
forums may be deleted. The Moderators may impose a First Level Sanction
on the poster. (Posts that are, in the opinion of the Moderators,
unintentionally made in the wrong Forum will be moved with no warnings
or sanctions, but perhaps with a caution.)
7. Second Level Sanction: The second time someone posts something that
violates the Forum 'acceptable usage guidelines', the individual will
be suspended from posting for a period of one week. This will be
announced in the Forums and the member will be notified via email.
8. Third Level Sanction: The third time someone posts something that
violates the Forum 'acceptable usage guidelines', the individual will
be suspended from posting for a period of one month. This will be
announced in the Forums and the member will be notified by email.
9. Fourth Level Sanction: The fourth time someone posts something that
violates the Forum 'acceptable usage guidelines', the individual will
be banned from the Forums, ie not permitted to log into
member-restricted areas of the USCF Forums. This will not be announced
in the Forums, but the member will be notified by email.
10. A banned individual may reapply in writing for access to the Forums
after a period of six months. The Executive Director will decide
whether or not the individual should be reinstated, and what
limitations or conditions will apply. A banned individual who has been
reinstated shall be considered henceforth to be in (at least) First
Level Sanction mode, as decided by the Executive Director under the
terms of reinstatement.
11. A First Level Sanction remains active on a member's record for a
period of one year. A Second or Third Level Sanction, once imposed,
remains active on the member's record for six months, and afterwards it
remains active on the member's record as a first level sanction for an
additional year. (Exception: A banned individual who is reinstated
always remains in at least the sanction level mode imposed by the
Executive Director under the terms of reinstatement.)
12. Past sanctions that are no longer active for sanction elevation
purposes may be used as evidence of behavior patterns in an appeal of
current sanctions.
13. The decision of a Moderator to impose sanctions may be appealed to
the Executive Director, who may decrease or increase the sanctions
imposed. The Executive Director's decision may be appealed to the
Executive Board in accordance with USCF procedures for disciplinary
aactions.
14. Members are held responsible for all posts under their user name.
Claims that a user name was hijacked or used without permission will
not be considered as mitigating circumstances regarding the initial
imposition of sanctions by the Moderators, but may be used as the basis
for an appeal of those sanctions, eg, to the Executive Director, with
adequate proof.

Is he saying that USCF makes public the names of those it bans from its
forum?
Oh, and Sam is incorrect, as it is posisble 1) that someone else who knows
who the fake is found out about the ban through their own access to the
site; and 2) someone other than mike, namely Sam himself, also knew about
the banning, so this doesn't "prove" anything about who it might be.
This "evidence" itself is miniscule in its implication of anyone and I would
not build an opinion based upon it.
